2.2 Development Agreement of an Industrial Plant
concluded between
Company X referred to as the Principal
and
Company Y referred to as the Contractor
as follows:
§ 1
| (1) | The obligations of the Contractor under this agreement shall include the drafting, the planning, the development, the completion, the evaluation, the transport and delivery onto the construction site, the procurement of land development works, the installation, the testing, the start of operations and maintenance (including guarantee services) of the industrial plant in … This shall be done for the purposes of completing a … according to the delivery specifications referred to in Annex I and within the deadlines set out in Annex II and in accordance with the technical features set out in the service specification of Annex III. |
| (2) | Unless expressly agreed otherwise, this agreement shall comprise all deliveries and services that shall be necessary for the turnkey completion of the turnkey referred to in subparagraph 1 above. |
